1. LICENSE AGREEMENT

Thank you for choosing our mockup; your support means a lot! We hope you find great satisfaction in using them for your projects.  However, we would like to address some important aspects related to mockup licensing. When you acquire a mockup, you are acquiring a tool to support your creativity, and are governed solely by the terms outlined in the End User License Agreement (EULA). Think of it as a binding contract that ensures the respectful use of the mockup. Failure to comply with these terms will constitute a breach of the agreement, preventing you from using the mockup. We appreciate your understanding and compliance with these licensing terms.

2. LICENSING MODEL

We grant you a perpetual, non-exclusive, non-transferable license to utilize our mockups. Our pricing structure is based on the amount of use you or your client will make. That scope being a factor for licensing purposes.

3. LICENSE SIZE

Mockup files (psd) are non-transferable, you agree not to provide the mockup to anyone and you agree not to exceed the usage limits unless you follow these terms.

(a) LICENSE STARTER: 

• if you bought a starter license as a freelancer for example, please do not share the mockup file with your clients, it is made for individual freelancers with 1 employees.
  
  
• if you bought a starter license you are permitted to use our product in an unlimited number of personal projects. “Personal use” means that you are not working under the instructions from a company or an organization. As a condition that you do not receive money or do not receive profits from certain projects.
  
  
• If you bought a starter license you are permitted to use our product in internal presentations, client pitches, and project proposals.
  
  
• If you bought a starter license you are licensed to use our product to Showcase designs on personal websites, portfolios, or self-promotional materials (excluding e-commerce platforms). 
  
  
• If you bought a starter license you are licensed to use our product to Showcase designs on up to 5 personal or professional social media accounts, as long as these are organic, unpaid posts.

(b) LICENSE STANDARD: 

• If you are part of a medium-sized studio with 2-5 employees, do not purchase a starter license, even if you will be the only designer working on a project using mockups. A standard license must be purchased by your studio or agency (and can be used by any designer/person in your office).
  
  
• if you or your client bought a standard license you are licensed to use our product in an unlimited number of personal projects. “Personal use” means that you are not working under the instructions from a company or an organization. As a condition that you do not receive money or do not receive profits from certain projects.
  
  
• if you or your client bought a standard license you are licensed to use our product to showcase it or display it on your client. If only the designer has access to them, then they are the only ones who are required to purchase a license. If the client also needs to use them on their side, then both must own a license.
  
  
• If you bought a standard license you are permitted to use our product in internal presentations, client pitches, and project proposals.
  
  
• If you bought a standard license, you are permitted to use our product for use in 5 defined commercial projects or campaigns.
  
  
• If you bought a standard license you are licensed to use our product to Showcase designs on personal websites, portfolios, or self-promotional materials (including e-commerce platforms). 
  
  
• if you bought a standard license you are licensed to use our product to Showcase designs on up to 5 personal or professional social media accounts, as long as these are organic, unpaid posts.
  
  
• If you or your client want to create an End Product that may be sold a total of 5.000 times, please purchase the Extended license.
  
  
• If you bought a standard license you are licensed to create Paid advertising campaigns with a total of unlimited. 
  
  

(c) LICENSE EXTENDED: 

• If you are part of a medium-sized studio or agency with 6-50 employees, do not purchase an extended license, even if you will be the only designer working on a project using mockups. A standard license must be purchased by your studio or agency (and can be used by any designer/person in your office).
  
  
• if you bought an extended license you are licensed to use our product in an unlimited number of personal projects. “Personal use” means that you are not working under the instructions from a company or an organization. As a condition that you do not receive money or do not receive profits from certain projects.
  
  
• if you bought an extended license you are licensed to use our product to showcase it or display it on your client. If only the designer has access to them, then they are the only ones who are required to purchase a license. If the client also needs to use them on their side, then both must own a license.
  
  
• If you bought an extended license you are permitted to use our product in internal presentations, client pitches, and project proposals.
  
  
• If you bought an extended license you are licensed to use our product to Showcase designs on personal websites, portfolios, or self-promotional materials (including e-commerce platforms).
  
  
• If you bought an extended license you are licensed to use our product to Showcase designs on personal websites, portfolios, or self-promotional materials (including e-commerce platforms). 
  
  
• If you bought an extended license you are licensed to use our product to Showcase designs on up to 5 personal or professional social media accounts, as long as these are organic, unpaid posts.
  
  
• If you or your client want to create an End Product that may be sold a total of unlimited times, please purchase the Extended license. 
  
  
• If you bought a standard license you are licensed to create Paid advertising campaigns with a total of unlimited.
  
  
  

4. RETURN POLICY

We aim to give you a great experience when you buy our product. But, please be aware that once you buy, it's final, and we don't do refunds. If you face any technical problems, reach out to us at: mockup.flock@gmail.comThis policy is to avoid accidental purchases, and when you buy our mockups, you agree to the terms in this EULA.

5. BUYING MOCKUP FILE FOR A CLIENT

As a payment facilitator, you have the option to procure mockup files on behalf of your client. It is imperative, however, that your client retains ownership of the license. This arrangement proves advantageous by enabling your client to seamlessly integrate the mockup files into their projects, thereby ensuring uninterrupted business operations. By managing the mockup file acquisition, you contribute to your client's time savings, allowing them to concentrate on core business activities. It is essential to bear in mind that your client remains accountable for strict adherence to the stipulated licensing terms and conditions.

6. COPYRIGHT AND TRADEMARK

We own the mockup product, and it's protected by copyright law. The design's intellectual property also belongs to us. When you buy it, you get a license, not ownership. This license is non-exclusive and non-refundable, giving you specific rights to use the mockup product. You can't sell or own the actual software or its design. We keep all other rights.

7.COMPATIBILITY AND USAGE

Mockup Flock provides mockup in photoshop (.psd). The mockups you download from our website are ensured to be valid, installable, and printable with 300 dpi. Their support depends on your system, software versions, or browsers. We recommend checking the relevant documentation for your system, software, or browser.

8. WARRANTS AND DISCLAIMER

The mockup is provided as-is. Mockup Flock does not offer any warranties, whether expressed or implied, including merchantability and fitness for a specific purpose. You take on all the risk regarding the quality and performance of the Mockup.

Mockup Flock cannot guarantee that the Mockup's functions will meet your needs or be error-free. Any implied warranties by law last for only thirty (30) days. After this period, there are no warranties.

Mockup Flock is not responsible for damages caused by the end user or third parties due to the misuse of the Mockup. The company may change this End User License Agreement at any time without prior notice to accommodate future commercial and technical changes.

9. MISCELLANEOUS

This contract is our entire agreement, replacing any previous discussions. Changes must be written and agreed upon by both parties. If one part is not enforceable, the other terms still apply, and we'll replace the unenforceable part. If we waive a right or allow something, it doesn't mean we'll do it again in the future.
